Provinces served with Notice of Constitutional Question

Formal notice of a constitutional question to be raised in the Federal Court and Federal Court of Appeal proceedings has been served on all provincial and territorial attorneys general in accordance with section 57 of the Federal Courts Act.

A copy of the Notices served in respect of the Federal Court and the Federal Court of Appeal proceedings are available for download.

In correspondence to provincial attorneys general, provinces were invited to apply for leave to intervene in the proceedings.

As of June 15, 2015, Manitoba has expressly advised that it will not be intervening in the Federal Court of Appeal.

A hearing date has not been set for either the application in Federal Court or the appeal of the respondents’ motion to strike in the Federal Court of Appeal.
