Affidavit evidence filed in Senate Vacancies case now available

The complete record of affidavit evidence tendered by the parties in the Senate Vacancies judicial review proceeding has been produced and is now available for download.

On June 23, 2015, the Applicant served the Affidavit of Aniz Alani and filed proof of service in accordance with Rule 306 of the Federal Courts Rules.

On July 23, 2015, the Respondents served the Affidavit of Christopher Manfredi in accordance with Rule 307 of the Federal Courts Rules.

An earlier affidavit was served on behalf of the Applicant on January 18, 2015 in accordance with Rule 306. It was limited to attaching publicly available materials which have since been duplicated and subsumed within the Affidavit of Aniz Alani of June 23, 2015 or will be relied on, by agreement of the parties, without the need to include within an affidavit.

Accordingly, the two affidavits linked above form the entirety of the affidavit evidence anticipated to be relied on by the parties in this proceeding.

Both affiants will be cross-examined on the contents of their respective affidavits in August 2015 in accordance with Rule 308 of the Federal Courts Rules.. A transcript of the cross-examinations would be included in the examining party’s application record in accordance with Rules 309(2)(e) and 310(2)(e).
