The respondents served their motion record in support of the motion to strike the notice of application for judicial review on February 13, 2015. The motion record includes, among other things, the respondents’ written argument setting out their position that the application for judicial review is fundamentally flawed and bereft of any possibility of success. The applicant’s responding motion record is due on March 20, 2015, and the hearing of the motion is currently set for April 23, 2015.

A case management conference will be held on February 16, 2015 to canvass the following issues raised by the Applicant: 1. Proposed amendments to Notice of Application 2. Respondents’ objection to transmitting tribunal record 3. Proposed adjournment of Respondents’ motion to strike until the outset of the hearing of the application for judicial review 4. Proposed dispute resolution conference 5. Proposed motion for adverse costs immunity order
